Judge: N.Y. must answer 9/11 Cleanup Claims

Judge won't toss claims by workers sickened by dust at Trade Center site

NEW YORK - A federal judge on Tuesday refused to toss out claims by thousands of emergency workers who sued New York City and about 150 private contractors after the workers were sickened by dust at the World Trade Center site. Judge Alvin K. Hellerstein dismissed claims against Consolidated Edison Co. and companies controlled by developer Larry Silverstein, saying they did not have legal control over the area and therefore were not liable for damages.

 

But Hellerstein said the city, its contractors, and the Port Authority of New York and New Jersey were only partially immune from lawsuits, with the precise scope and extent of the immunity varying according to date, place and activity.

 

Andrew J. Carboy, a lawyer for plaintiffs, called the judge’s decision “a first step forward in the legal system for these other victims of 9-11.

Space should be maintained as a global commons for all of Mankind.

This is solely about a STOOPID desire to weaponize space.

To quote Kevin Sanders, a speech writer for Ronald Reagan  (who's speeches on this type of matter were edited to lop off pesky sentences like, "As we reach for the stars, we invite the people of the world to join us in this grand odyssey."), who wrote in 1998:

U.S. says shift is not a step toward arms

President Bush has signed a new National Space Policy that rejects future arms-control agreements that might limit U.S. flexibility in space and asserts a right to deny access to space to anyone "hostile to U.S. interests."

 

The document, the first full revision of overall space policy in 10 years, emphasizes security issues, encourages private enterprise in space, and characterizes the role of U.S. space diplomacy largely in terms of persuading other nations to support U.S. policy.

 

"Freedom of action in space is as important to the United States as air power and sea power," the policy asserts in its introduction.

 

National Security Council spokesman Frederick Jones said in written comments that an update was needed to "reflect the fact that space has become an even more important component of U.S. economic, national and homeland security." The military has become increasingly dependent on satellite communication and navigation, as have providers of cellphones, personal navigation devices and even ATMs.

A War Of Equals

As of yesterday the population of the USA hit 300 million people.

Iraq is a country of 25 million people.

That means we're 12 times bigger than they are.

So, if this was a war between equals, and one side, Iraq, lost 400 to 800 thousand people, if you multiply those numbers by 12, it would be like having 5 to 10 *million* people dead here in the USA.

There's a word for somebody that picks a fight with someone 12 times smaller than them:

Device allows researchers to measure the activity of an exercising shrimp

 

A sluggish, sick human is easy to spot. But it's harder to tell when a shrimp is under the weather. So one scientist put the little crustaceans on a tiny treadmill to examine how diseases impact their performance.

 

Humans fighting an infection typically sleep more and are not at top physical performance. "The situation is much more critical for a sick marine crustacean, such as a shrimp, where a decrease in performance may mean the difference between life and death," said David Scholnick, a biologist from Pacific University.

 

The shrimp treadmill, invented and built by Scholnick, allows researchers to measure the activity of an exercising shrimp for a set period of time at known speed and oxygen levels.

Mathematics and Relevancy

Correlation is not causation. There are distinct audiences for mathematical concepts, and the farther one travels in school's course work, the greater this distinction becomes. In order for me to understand geometry, trigonometry, and algebra, I needed to occasionally 'see' real life applications to link math concepts with my 'reality'. When I took my first calculus course, I couldn't find the relevancy because my teachers wouldn't/couldn't describe real-life application examples. For me, I understand that I'm not a mathematican. I can't be one because I can't think in the 'abstract' using the rules of mathematics that are the basis of the science. What a crime! However, because I can 'see' application, I travel easily in the fields of statistics (univariate and multivariate) and know surveying math. Yes, I can't derive new applications of math principles, I can't compute rocket trajectories, I can't compute solutions to math inigmas, but I know how to apply math principles to derive answers to current questions that relate to the environment, the natural history of species, and contaminants in the environment. There are two audiences for math, each with a valid and specific needs. We should never confuse those who learn 'application' and those who practice 'derivation'. The U.S. may not be at the pinnacle of new math, but, wow, we're good at application. There is room for both in our classrooms.

I couldn't get over my own shock that what Keith says is so true and so absolutely necessary. We live in a cowardly America and due to our choices, we have neither safety nor freedom.

I am truly afraid he called it right, except for one thing. The guy who will wrongly use the bill will be Bush/Cheney himself.

They will go after the left wing media (i.e. the internets) via chertoff; then the political opposition, just like Nixon wanted to.

Where's the clip of Bush wishing the US were a dictatorship? It fits him to a "T". Congress has handed over our freedom to a man who only intentions ror Americans has been demonstrably malicious.

Yesterday, Bush visit the Pettys, the NASCAR legends from NC.

Not to take anything away from the charity of the organization, but...some of us have a longer memory about one of the Pettys, namely Richard Petty, who made into the News of the Weird some years ago:

"1996 -- Stock-car racing legend Richard Petty, running for North Carolina secretary of state, paid a $65 fine in September for improperly bumping a car that wouldn't let him pass in the left lane on Interstate 85. According to a state trooper, Petty said if the driver got in front of him again, he was going to knock his "rear end" off the road. Petty told a reporter, "Now if it had been a NASCAR showdown, [the driver] would have been over in the ditch somewhere." "

There was another quote from Richard Petty, who ran on the Republican ticket (and lost), about his decision to bump the passenger car on I-85. The quote, offered after he realized he as in trouble, was in the papers. I liked it because, as I recall, it had every possible wrong conjugation of the verb "to do" that could be crammed into one sentence. It went something like this (poor paraphrase from memory):

"If I'd of knowed what I did would cause so much trouble before I'd did it, I can tell you I wouldn't have never did it."

Ah, savor the precious moments in NC politics...

Just so there's no misunderstanding...

...all that stuff I said earlier about "natural linguistic evolution" doesn't apply to redneck Republican NASCAR dudes.  In those cases, I'm more than willing to write it off to slack-jawed yokelism and corn-fed, Busweiser-swillin' inggernints.

See, what Petty did was a shining example of compassionate conservatism. Read the quotes again. See, Petty merely bumped the car, when he WANTED to knock it off the interstate and into a ditch. Isn't that compassion? See? Compassion -- yeah, that's it.

As for beer, NASCAR's origins lie in building cars that could outrun the "revenoors" -- the G-men or feds who were trying to collect taxes on illegal income from the sale of alcohol from stills, especially in the hills and mountains. It would be a charming little history if stills were the whole story. Most people grudgingly admire or at least tolerate people who ran booze during Prohibition. And most of western NC stayed dry long after Prohibition ended. Running booze had an aura of outlaw glamour for some people in those days.  Even NASCAR will tell you this much about its history.

But, there's something NASCAR web sites seem never to talk about. It's true that the feds were sniffing out illegal stills to shut down bad hootch factories and to collect taxes. But they were also looking for something else that was much more sinister and that has always seemed to exist alongside the stills, even as far back as the 19th Century. 

I'll let you figure out what the feds were really looking for while they busted up stills. Let's just say that, knowing the whole history, I like the feds better than NASCAR, and I don't mind the feds whacking a few stills if it helped root out the other rotten thing. I have never attended a single NASCAR event and snap my radio and tv off when NASCAR news comes on. Can't get past their history.

It is the only major beer made in America, that is made from "Rice".  Nascar is therefore a communist plot to destroy America by making us Asian Dependent.
